1. Acceptance of Terms

By accessing or using the services provided by Obastion Pte. Ltd. (“Obastion”, “we”, “us”, or “our”), including the website at obastion.com and the LynxLedger platform, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our services.

2. Service Description

Obastion provides bookkeeping, finance operations support, financial statements preparation support, bank reconciliation, invoicing, and related services for businesses. Our services are delivered by our in-house team using the LynxLedger platform.

We do not provide statutory audit, assurance, or other services reserved to licensed audit professionals. Corporate services such as incorporation, nominee arrangements, and registered office services are not included unless separately agreed in writing.

3. Account Registration

To use certain features, you must register an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your password and for all activities under your account.

4. Payment Terms

Fees for our services are set out on our pricing page and in your service agreement. All fees are quoted in US dollars unless otherwise stated. Payments are processed through Stripe. By subscribing, you authorise recurring charges at the applicable billing interval (monthly or annual).

If payment fails, we will notify you and may suspend services after a reasonable grace period. Refunds are handled on a case-by-case basis. Historical cleanup and one-time onboarding projects are non-refundable once work has commenced.

5. Acceptable Use

You agree not to:

Use our services for any unlawful purpose or in violation of any applicable laws or regulations.
Provide false, misleading, or fraudulent financial records or information.
Attempt to gain unauthorised access to our systems, networks, or other users' accounts.
Interfere with or disrupt the integrity or performance of our services.
Resell, sublicense, or redistribute our services without prior written consent.

6. Intellectual Property

All content, software, and technology provided through our services, including LynxLedger, are owned by or licensed to Obastion and protected by intellectual property laws. You retain ownership of your financial data and records. We retain ownership of our processes, templates, workflows, and platform.

7. Confidentiality

We treat your financial data as confidential. We will not disclose your information to third parties except as required to deliver our services (e.g., integration with your accounting software), as required by law, or with your prior written consent.

8. Data Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Service Availability

We strive to maintain high availability of our platform and services. However, we do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for any loss arising from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Obastion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of our services.

Our total aggregate liability for any claim arising from or related to these Terms shall not exceed the total fees paid by you to Obastion in the twelve (12) months preceding the claim.

11. Termination

Either party may terminate the service relationship with thirty (30) days' written notice. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, we will provide reasonable access to export your data for a period of thirty (30) days.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through our platform. Continued use of our services after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
